GENERAL TERMS AND CONDITIONS OF SALE (T&Cs) – ABEE

1) IDENTITY OF THE SELLER – CONTACT
These General Terms and Conditions of Sale (hereinafter “T&Cs”) are offered by:
MCGB ASSOCIES, a simplified joint-stock company (SAS) with share capital of €10.00, registered in the Paris Trade and Companies Register under number 988 470 837.

2) SCOPE OF APPLICATION
These T&Cs apply to any order for products placed by a consumer (within the meaning of the French Consumer Code) on the ABEE online shop.
Any order implies unreserved acceptance of the T&Cs in force on the day of the order.

3) PRODUCTS – INFORMATION
The products offered are care products intended for external use on horses.
The essential characteristics, instructions for use and precautions are set out on the product pages and/or the labelling. Photographs/visuals are non-contractual.

4) PRICES
Prices are given in euros (€), all taxes included (TTC), excluding shipping costs (unless otherwise stated).
MCGB ASSOCIES reserves the right to modify its prices at any time. The applicable price is the one displayed at the time of order validation.

5) ORDER
5.1 Order process
The customer selects the products, checks the summary (quantities, prices, delivery), then validates the order and proceeds with payment.
The order is considered final after:
- payment validation, and
- sending of an order confirmation email.

5.2 Refusal / cancellation
MCGB ASSOCIES reserves the right to refuse or cancel any order on legitimate grounds (e.g. payment incident, fraud, abnormal order).

6) PAYMENT
Payment is made online via the means offered at checkout (e.g. bank card and payment solutions available on the shop).
The order is only prepared after effective receipt of payment.

7) RETENTION OF TITLE
The products remain the property of MCGB ASSOCIES until full payment of the price, including costs and taxes.

8) DELIVERY
8.1 Zones
Delivery offered in mainland France and in the European Union (and, subject to feasibility, other destinations on request).

8.2 Timelines
Unless otherwise stated:
- preparation: within 48 working hours after payment confirmation,
- indicative delivery: mainland France 2 to 4 working days, European Union 3 to 7 working days.
These timelines are indicative and may vary (carrier, peak periods, unforeseen events).

8.3 Shipping costs
Shipping costs (unless special offers) are calculated automatically at checkout and displayed before validation.

8.4 Transfer of risk
The risk of loss or damage is transferred to the customer upon physical possession of the parcel by the customer (or a designated third party, other than the carrier).

8.5 Delivery issues
In the event of a lost or damaged parcel or a major delay, the customer must contact customer service as soon as possible at contact@abee-horse.com so that a solution can be offered.

9) RIGHT OF WITHDRAWAL (DISTANCE SALES – CONSUMERS)
9.1 Timeframe
The customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to give a reason.

9.2 Exercise of the right
To exercise the right of withdrawal, the customer must notify their decision before the expiry of the 14-day period:

The customer may use the standard form provided in the appendix, but this is not mandatory.

9.3 Return of products
The customer must return the product(s) without undue delay and at the latest within 14 days of notification of withdrawal, to the following return address:

Products must be returned in their original condition, complete, unused, in their original packaging where possible, and accompanied by proof of purchase.

Except in the event of our error or a non-conforming product, return shipping costs are borne by the customer.

9.4 Refund
In the event of valid withdrawal, MCGB ASSOCIES will refund all sums paid, including standard shipping costs (excluding additional costs due to a more expensive shipping method chosen by the customer).
The refund will be made no later than 14 days from the date on which MCGB ASSOCIES is informed of the decision to withdraw.
MCGB ASSOCIES may defer the refund until the products have been recovered or until the customer has provided proof of shipment (the date used being the earlier of these two events).

The refund is made via the same means of payment as that used at the time of purchase, unless expressly agreed by the customer.

9.5 Exceptions (no right of withdrawal)
The right of withdrawal does not apply in particular:
- to goods made to the consumer's specifications or clearly personalised,
- to sealed goods which cannot be returned for reasons of hygiene or health protection and which have been unsealed after delivery,
- and, more generally, to cases provided for by law.

10) LEGAL GUARANTEES
10.1 Legal guarantee of conformity
The customer benefits from the legal guarantee of conformity applicable to goods sold by a professional. In the event of a lack of conformity, the customer may request the bringing of the good into conformity (repair/replacement) or, failing that, a reduction in price or the resolution of the sale, under the legal conditions.

10.2 Legal guarantee against hidden defects
The customer also benefits from the legal guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), allowing, depending on the case, the cancellation of the sale or a reduction in price.

10.3 Implementation
For any request related to a guarantee, the customer contacts MCGB ASSOCIES at contact@abee-horse.com, describing the problem and attaching any relevant elements (photos, order number, etc.).

11) LIABILITY
MCGB ASSOCIES cannot be held liable for damage resulting from improper use of the products, non-compliance with usage precautions, or use not in accordance with the product's intended purpose.
In any event, MCGB ASSOCIES' liability may not exceed the amount of the order concerned, unless mandatory legal provisions provide otherwise.

12) PERSONAL DATA
Personal data are processed in accordance with the privacy policy available on the ABEE shop. The customer is invited to consult it.

13) INTELLECTUAL PROPERTY
All elements of the site (texts, visuals, logos, trademarks, content) are protected and remain the exclusive property of MCGB ASSOCIES or its partners. Any unauthorised reproduction or use is prohibited.

14) AMICABLE SETTLEMENT – CONSUMER MEDIATION
In the event of a dispute, the customer must first contact customer service at contact@abee-horse.com to seek an amicable solution.

Failing an amicable agreement, in accordance with articles L.616-1 and R.616-1 of the French Consumer Code, the consumer customer may free of charge use a consumer mediator:

Note: the European online dispute resolution platform (ODR) closed permanently on 20/07/2025.

15) APPLICABLE LAW – DISPUTES
The T&Cs are governed by French law.
In the event of a dispute, and after an attempt at amicable resolution, the consumer may refer the matter to the competent courts in accordance with applicable rules.
